BRECKNOCK FARMERS MARKETS
TERMS AND CONDITIONS
1. Aims
Brecknock Farmers Market aims to provide a forum in which small scale producers and growers can sell fresh, wholesome and quality produce direct to the public. A steering group elected anually by the membership at the Annual General Meeting shall manage Brecknock Farmers Market.
2. Membership
Producer membership shall be open to any person, society or association who, in the opinion of the Steering Group is a local producer or processor of food or drinks or other products and who wants to sell direct to the public.
Non-Producer membership is open to any person who in the opinion of the Steering Group supports the aim of the market.
All produce sold must be grown, reared, pickled, baked, smoked or processed by the stall holder. Processed foods should contain at least 10% local ingredients wherever possible.
The principal producer must attend the stall or a representative involved in the production process.
There must be no middlemen / traders at the farmers market.
3. Steering Group
The Steering Group shall consist of the Chairman, Secretary, Treasurer and at least three ordinary members. The Chairman and one other member of the Steering Group shall be a non-producer, unless circumstances do not allow. A market manager shall be appointed by the Steering Group and shall be co-opted onto the Steering Group.
The Steering Group can co-opt any person onto the Steering Group to deal with specific issues as required.
4. Producers Membership Criteria
Any producer who attended any of the markets held in 2000 is eligible for membership without needing to apply.
* An applicant for membership should be:
Local. Approximately within 10 miles of Brecknock District. Where there is space at the market, the most local producer will receive preference (not to the detriment of quality and subject to the discretion of the manager).
Selling their own produce. Able to provide quality produce that will add variety and interest to the range of stalls at the market. Agrees to bide by the general market regulations. The Steering Group, at its discretion may make exception to any of the above.
5. Trading
The market will be held on the second Saturday in January, February, March, April, May, June, July, September, October, November and December - or other opportunities as they arise.
Trading Times:
Traders should be ready to trade when the market opens and not leave until closing time. Opening and closing times, at present are 10am to 2pm.
Market Location: The regular market location is at Brecon Market Hall.
The Steering Group may at its discretion alter any of the above and will inform membership of any changes.
6. Membership Fees
Membership will be £15 to cover administrative costs and will entitle members to trade at the Farmers Market and also vote at the Annual General Meeting.
7. Market Fees
Market fees will be set at the discretion of the Steering Group and for the present will be £25.
8. Market Manager
The responsibilities of the Market Manager will include on-site management of each market, enforcing compliance with all the regulations and deciding all disputes on the day, disputed decisions may be appealed later to the Steering Group.
9. Stallholders
Each stallholder will display a notice giving their name, business name, address, phone number and where applicable organic certification number.
10. Foods and Drink
All stallholders selling any food or drink products at the market must have and display a valid recognised food hygiene certificate.
11. Safety
Stallholders are responsible for the safety, sanitation and removing all debris and abiding by all Market, Local Authority and other relevant regulations. Scales must be certified for trade.
12. Insurances
Members must maintain Public, Employee and Products Liability Insurance.
13. Supporting the Aims
Members at all times will act to support the Aims of Brecknock Farmers Market Limited.
14. Annual General Meeting
The Annual General Meeting of the Brecknock Farmers Market LImited will be held in January or February to hear the Chairman's report, to receive the Treasurer's report, to appoint an auditor and to elect the Steering Group for the following year.
15. Funds of the Market
The funds of the Market will be held in an account at Barclays Bank. Withdrawal of funds shall require the signature of the Treasurer and one of two other signatories appointed by the Steering Group.
16. Misconduct
Case of alleged misconduct, which is deemed by the Chairman to be worthy of investigation, shall be examined by three of the Steering Group. Should they decide there is a case to answer then they may by means of a notice in writing to inform the Member concerned that the matter will be raised at the next meeting of the Steering Group. The notice shall allow the member at least one week to prepare a written or verbal submission to the Steeering Group. If the Officials first examining the matter consider that urgent action is necessary, then they shall have the power to suspend the Member from being able to trade at the Brecknock Farmers Market if two thirds of the Steering Group present agree. The decision of the Steering Group is final.
